Terms of Service

By accessing or using the Services, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy. If you are entering into these Terms on behalf of a team or brokerage, you represent that you have authority to bind that organization, and "you" includes that organization.

The Services are intended for licensed real estate professionals and their authorized staff. You must be at least 18 years old and able to form a binding contract. You are responsible for ensuring that your use of the Services complies with your license, brokerage policies, and applicable law.

Realtipro provides a subscription platform that may include the CRM and mobile app, IDX websites and admin panel, CMA reports, RIA AI, Listing AI, market intelligence, the MarketIQ marketing suite (flyers, social graphics, video generator, and email campaigns), and team and brokerage dashboards, lead routing, reporting, and recruiting tools. Features available to you depend on your plan.

We may add, change, or discontinue features over time. We are not a party to any transaction between you and your clients, and we do not guarantee any business result, listing, lead, or sale.

You must provide accurate, complete information and keep it current. You are responsible for safeguarding your credentials, for all activity under your account, and for the conduct of the users and seats you provision. Notify us promptly at info@realtipro.com of any unauthorized use or security incident.

The Services are offered on individual plans (Basic, Growth, and Professional) and brokerage plans (Brock-Entry, Brock-Premium, and Brock-Enterprise), on a monthly or annual basis, billed per plan and, where applicable, per seat, at the prices shown on our pricing page or in your order.

• Auto-renewal — subscriptions renew automatically for the same term unless cancelled before the renewal date. You authorize us and our payment processor to charge your payment method on each renewal.
• Taxes — fees are exclusive of taxes, which you are responsible for.
• Price changes — we may change prices; for existing subscriptions, changes take effect at the next renewal after reasonable notice.
• Non-payment — we may suspend or terminate access for failed or overdue payments.
• Refunds — except where required by law or expressly stated, fees are non-refundable, including for partial periods and unused seats.

You agree not to, and not to permit anyone to:

• Use the Services for anything unlawful, deceptive, discriminatory, or in violation of Fair Housing or advertising laws;
• Send messages that violate CAN-SPAM, TCPA, Do-Not-Call, or anti-spam rules, or contact people without a lawful basis or required consent;
• Upload data you do not have the right to use, or infringe others' intellectual property or privacy;
• Scrape, harvest, reverse engineer, decompile, or attempt to derive source code, or copy or resell the Services;
• Interfere with, overload, probe, or bypass the security of the Services;
• Share, sublicense, or transfer your access, or exceed your licensed seats;
• Use AI features to generate misleading, fraudulent, discriminatory, or non-compliant content.

IDX and related features rely on data licensed from Multiple Listing Services, including NWMLS. You represent and warrant that you hold the MLS membership, IDX authorization, and rights required to display and use that data, and you agree to comply with the applicable MLS and IDX rules, including display, attribution, and update requirements.

We may modify, restrict, or suspend IDX functionality as needed to comply with MLS requirements. We may suspend or terminate access if you violate MLS or IDX rules, or if an MLS directs us to do so.

As between you and Realtipro, you retain all rights to the data and content you upload or generate, including your Customer Data ("Your Content"). You grant Realtipro a worldwide, non-exclusive license to host, process, transmit, display, and adapt Your Content solely to provide and improve the Services and as directed by you.

You are solely responsible for Your Content and for having all rights, permissions, and consents necessary to upload it and to send communications through the Services.

RIA AI, Listing AI, market intelligence, and the MarketIQ tools generate outputs from the inputs you provide. Subject to these Terms, you may use those outputs for your real estate business. AI output is provided "as is," may be inaccurate, incomplete, or similar to output generated for others, and is not legal, financial, or valuation advice.

The Services, including all software, designs, text, graphics, and the Realtipro name and logos, are owned by Realtipro or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services during your subscription for your internal business use. All rights not expressly granted are reserved.

If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you.

The Services may integrate with third-party products (for example payment processing, messaging, or AI providers). Those products are governed by their own terms and privacy policies, and we are not responsible for them. Your use of a third-party product is at your own risk.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any data, CMA, market estimate, or AI output will be accurate or complete. CMA reports and market intelligence are informational estimates, not appraisals or guarantees of value.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REALTIPRO AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

You agree to indemnify and hold harmless Realtipro and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Services, your communications with clients and leads, or your violation of these Terms, applicable law, or MLS or IDX rules.

These Terms remain in effect while you use the Services. You may cancel your subscription at any time, effective at the end of the current billing term. We may suspend or terminate your access if you breach these Terms, fail to pay, or create risk or legal exposure for us or others.

On termination, your right to use the Services ends. We will make Your Content available for export for a reasonable period, after which we may delete it in the ordinary course, subject to legal and backup retention.

We may update these Terms from time to time. When changes are material, we will update the "Last updated" date and provide reasonable notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules. Before filing a claim, you agree to contact us at info@realtipro.com to try to resolve the matter informally. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in Washington, and you consent to venue there, except where applicable law provides otherwise.

These Terms, together with our Privacy Policy and any order or plan you subscribe to, are the entire agreement between you and Realtipro regarding the Services. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays or failures caused by events beyond its reasonable control.
